Two Magistrates in NSW have been directed to show cause to the NSW Parliament why they should not be sacked as Judicial Officers.
The magistrates in question are Magistrate Jennifer Betts and Magistrate Brian Maloney and it was based on the findings of the NSW Judicial Commission enquiry in relation to complaints of misconduct which led to them to being required to show up to the NSW Parliament and argue why they should not be sacked.
Both magistrates have claimed they suffer from mental illnesses which led to them behaving the way they did and resulted in the complaints being made against them. They both say the problem has been fixed with medication they are now taking.

Some of the things he says are:
“‘Shut up please, ma’am. I’m going to talk to you now and you listen hard . . . That’s a disgusting response . . . Your explanations are pitiful . . . And you think you’re god’s gift, do you? . . . Shut your mouth, because I don’t think it’s going to do you any good.” That was the magistrate Jennifer Betts in full cry at Ryde Local Court in June 2009.”
“Judges and magistrates are supposed to look as though they are dispassionately deciding people’s cases and giving them fair hearings, even though in their heart of hearts they might have made up their mind, or they can’t stand the sight of the person appearing before them.”
“Most journalists are quite insane and as for politicians, well, the peculiar state of their mental hygiene is visible for all to see.”
“Having politicians judging judicial officers is a bit like having one branch of the asylum acting as caretakers for another. It seems to be one tiny corner where judges failed to properly nail down their ”independence”.”

People might have the impression that there is oversight of Judges and Magistrates in Australia. But the reality is that only NSW has a Judicial Commission to investigate complaints against judicial officers. Federally there is nothing and none of the other states have an independent body to investigate complaints, as such complaints about judges and magistrates are pissed down the toilet by the politicians, police and Chief Justices of those courts where the complaints are made.
Just for the record the NSW Judicial Commission is nothing but a bad joke and corrupt as hell. It is judges who control it. Why they recommended possible action against the two magistrates I suspect is just a case of the NSW Judicial Commission making it look like they are doing their job. Knowing full well that nothing will happen to the two magistrates as know one will kick a person while they are down with the two magistrates playing the mental illness defence. While the real criminal and corrupt conduct by Judges and Magistrates is swept under the carpet.
At the time of writing this Magistrate Jennifer Betts has been cleared by Parliament and will continue as a Magistrate with Magistrate Brian Maloney to go before parliament next week to defend himself. (Click here to read the article)

Maloney is not mentally ill. He’s just a common, everyday narcissist, nightmare.
He believes, and is obviously, frighteningly correct, that he is autonomous.
He is a Court Dictator, behaving as badly as he so desires. No accountability.
being ‘autonomous’ is not a licence to be rude or disrespectful or act as if they are god almighty. As Shane has told them – you are a simply a public servant paid for by me and I demand you give me the respect I deserve.
I also appeared before Brian Maloney on a minor matter some years ago. He asked my solicitor representing me at Central Local Court, personal questions about myself that were not pertinent to my court case. His questions appeared in the transcript which was later accessed by the media, after someone (I presume the prosecution) in the court had tipped off a journalist. The media twisted what was actually said in court. I wasn’t happy as you can guess. Instead of being punished once by the court system – I was punished again by Maloney’s behaviour and then again by the media. I’ve lost all respect for the NSW justice system as a result.
I have appeared in front of the ” mad hatter” Jennifer betts in December 2011, she acted like a loony, may be she has missed out on her medications. she think and she acts as if she is god all mighty, it was not a normal behavior from an average person, let alone she is sitting on the court and deciding other peoples lives, which effects their children, families and elderly. well the mental illness is not a flu, its a psychological dysfunction. her own mind is in dysfunction. that explains why she was acting like a supermarket woman selling at last minutes. shouting and screaming … it was appalling act come from a court magistrate. she is incompetent in carry out her official duties as such, she needs urgent medical assistant before more families and more innocent people being hurt for her personal mental illness. state Judicial Commission seems to be incompetent in their duty of care to the general public, they certainly neglecting the welfare of general public, that’s appalling ….
this is the kangaroos court ( mind you kangaroo don’t have mental illness ) also koala’s making judgement oh well who cares, the koala is high all day on her medications or forgot her medication …
how could a person with mental illness be qualified as fit for this very high and extremely demanding position? she is dysfunctional in psychological process, she is incompetent in her own mental health. she needs to be hospitalized for urgent and immediate treatment.
I too was unfortunate enough to appear before her recently ,we sat there and listened to her handing down a judgment for 6 hours ,it was complete dribble ,the rambling of a person not in control of their facilities ,we could either not hear her or she would be screaming .She was not interested in following the case or the evidence she had prejudged and could not put down a balanced opinion if her life depended on it.Why is it that ever legal mind in the country all have the same opinion “oh you are before Betts you poor bugger” Yet she remains there destroying lives ,families and reputations .Please someone this has to stop!
We are too going through the process of the NSW Court system and are totally shocked by the amount of corruption and how innocent people are having their lives ruined by these incompetent people. Then to read on here that even if you complain, nothing will happen. Why aren’t the “honest” people in the legal profession doing something about this????????????????
because the honest people in the profession are too scared to speak up because their careers will be ruined. The solicitors professional rule are in place by the system for the purpose of muzzling speaking out by those who are honest
