Alan Jones sues SBS for defamation for implying he is a paedophile, racist and liar. So where’s the defamation?

Former 2GB radio announcer and current Sky News host Alan Jones is suing the SBS and SBS presenter Alex Lee for defamation which seems to be an attempt to re-write history as I personally can’t see a problem with what they have said about Jones. I put 30 questions to Alan Jones’s two barristers and lawyer as per below which they failed to respond.

The SMH reported on Thursday (15/10/20):

“Veteran radio and television broadcaster Alan Jones is suing public broadcaster SBS for defamation over a television segment which he claims “greatly injured” his reputation by wrongly portraying him as a racist, a misogynist and a liar.” But they left the paedophile allegation right until the end of the article and gave no explanation what it was about although other media did.

The Guardian reported on Friday (16/10/20):

One of the alleged imputations was that “Mr Jones was a paedophile in that he had written a love letter to a schoolboy” and another that “he was a hypocrite, in that although being a broadcaster he had sued for defamation countless times”.

In the segment on The Feed, which has now been taken down by SBS, Lee said Jones “made a career out of bullying people” and “spread lies and fake news”, according to court filings.

She is also accused of mocking politicians, including Scott Morrison and Tony Abbott, for delivering what she described as “suck up tributes” to Jones. Lee said politicians “lined up to get one more wedgie for the road” during his final days on air on 2GB.

Days before he retired from 2GB, he was found to have breached broadcasting codes for decency in his use of “violent metaphors” about the New Zealand prime minister, Jacinda Ardern, and accuracy in his comments about climate change.

“So here is my tribute,” Lee said according to documents filed in court. “Alan Jones spoke to the fears of every xenophobe and misogynist in the country. He gleefully used racial slurs, saying the N-word twice on air. He spread lies and fake news about climate change and repeatedly tried to undermine the severity of the coronavirus, whilst isolating in his country estate. (Click here to read more)

The problem for Jones at least in relation to the paedophile allegation is that he has now admitted that an adult sending a love letter to a schoolboy could be viewed that the adult sending it is a paedophile. So now Jones has to explain why he has not sued others such as Chris Masters, the SMH and myself for saying the same thing which I put to Jones’s lawyers today in the 30 questions below.

I have some questions for an article I am writing about Alan Jones and his defamation lawsuit against the SBS and SBS presenter Alex Lee.

  1. Can you confirm that Alan Jones threatened the ABC and former ABC journalist Chris Masters in 2005/2006 not to publish the book “Jonestown”?
  2. Can you confirm why Alan Jones never sued for defamation after the book “Jonestown” was published in 2006 by another publisher after the ABC refused to publish it after the threat?
  3. Can you confirm the following extract in the book “Jonestown” as published by the SMH on the 21st October 2006 as being true and correct:

Jonestown: The Power and The Myth of Alan Jones – Author: Investigative journalist Chris Masters

Extract as written in the SMH regarding Alan Jones time teaching at The King’s School 1970-73:

“By 1973 Alan’s impassioned support of some and lack of empathy for others became too great an issue to be ignored. There was deepening anxiety about continued late-night excursions to Jones’s room. Chris Simkin was often in the room with Alan until late at night. “I was in there for hours. The door was never locked.” Simkin says they used to watch The Ernie Sigley Show on television.”

“Scott Walker, another constant visitor, began to feel violated. “If you had muscle strain he would insist on strapping your legs. He would take you into the shower and tell you to take your clothes off. I was shattered with awkwardness. It was weird and uncomfortable and seemed voyeuristic.”

“Housemate Brian Porter says: “I never saw a breach of fiduciary duty. I never saw evidence of predatory behaviour. But he was manipulative and voyeuristic. He would love watching athletes on television and film. He saw the beauty of the human form in full flight. He loved the strength, the freshness and the vitality of boys.”

“Disquiet about Jones’s attachment to some boys grew during a term break when one of the masters found a letter, written by Jones to a boy, that had been left behind in a classroom desk. In it Alan spoke of thinking about the boy late at night, expressing his love. While love letters to boys were hardly appropriate, neither were they regarded as smoking-gun evidence of misbehaviour.”

  1. Can you confirm that Alan Jones sent a love letter to a schoolboy as written by Chris Masters in the book Jonestown?
  2. If Alan Jones denies sending a love letter to a schoolboy as stated in Jonestown and on the SMH website then can you explain why Allan Jones never sued Chris Masters, the publisher of Jonestown or the SMH?

The “2GB’s Alan Jones sent love letters to a schoolboy. Why has he never been charged with grooming?” article

  1. On the 31st May 2015 I published an article titled “2GB’s Alan Jones sent love letters to a schoolboy. Why has he never been charged with grooming?” on my website Kangaroo Court of Australia. Can you explain why Alan Jones has never complained about the article given he is suing the SBS and Alex Lee for saying he sent a love letter to a schoolboy?
  2. Does Alan Jones agree that if a teacher sent a love letter to a schoolboy that the teacher would be charged with grooming?
  3. In the same article I said:

It is well-known that you can buy Alan Jones opinion, it’s just a matter of how much. That was revealed in the cash for comment scandal is 1999 which was “paid advertising in radio that is presented to the audience in such a way as to sound like editorial commentary”.

“John Laws and Alan Jones had been paid to give favourable comment to companies including Qantas, Optus, Foxtel, Mirvac and major Australian banks, without disclosing this arrangement to listeners.” (Click here to read more) Both Richo & Jones had their snouts in the trough for the Cash for Comment scandal as it turned out. So they go way back when it comes to corruption.

Why has Alan Jones never complained about my article given he is suing the SBS and Alex Lee for saying he took money from companies to promote their products on air?

  1. Can you confirm that Allan Jones was forced to resign as a teacher at The Kings School in Sydney in 1973? If yes, can you explain why?
  2. Is Alan Jones still good friends with known paedophile protector and former crown prosecutor Margaret Cunneen as I wrote in the article?
  3. Is Alan Jones still good friends with convicted murderers and drug dealers Roger Rogerson and Glen McNamara as I wrote in the article?

The “Alan Jones is under investigation by NSW Police for statutory rape of boys in the 1980’s” article

  1. On the 25th of June 2016, I published an article titled “Alan Jones is under investigation by NSW Police for statutory rape of boys in the 1980’s”. Why has Alan Jones never complained about that article?
  2. The article started off: “Fairfax Media’s 2GB radio host Alan Jones is under investigation by the NSW Police for the statutory rape of underage boys in the 1980’s. I have raised the issue with Fairfax Media, the ABC Board and the Prime Minister’s office and I am still awaiting responses.” Is Alan Jones aware that I raised the issue with his employer and others?
  3. Given I raised the issue with Alan Jones employer and published the email as per below why didn’t Alan Jones or his employer respond to the email?

The questions relate to Alan Jones who works for Fairfax Media as a radio announcer on Fairfax’s 2gb radio station.

  1. Are you aware that the NSW Police are currently investigating Alan Jones, Fairfax Media and 2gb radio announcer, for statutory rape of schoolboys in the 1980’s?
  2. Are you aware that Alan Jones is a known paedophile who groomed schoolboys when he was a teacher at The King’s School in Parramatta Sydney in the 1970’s?
  3. Are you aware that documented evidence against Alan Jones for child grooming is well-known and freely available in the book Jonestown (2006) with extracts detailing the child grooming easily accessible on the internet including on Fairfax Media’s websites?
  4. Are you aware that the Royal Commission into Institutional Responses to Child Sexual Abuse is currently investigating abuse at The King’s School which includes the time when Alan Jones was a teacher there?
  5. Are you aware that Alan Jones is good friends with corrupt former police officers Roger Rogerson and Glen McNamara who have both recently been convicted of the death of Jamie Gao?
  6. Given the uncontested evidence and allegations against Alan Jones do you plan on sacking Alan Jones or at the very least standing him down from further duties until the NSW Police and Royal Commission have completed their investigations?

Can you please respond ASAP so I can publish your response in my article.

The “Alan Jones is back grooming young male students for his sexual pleasure” article

  1. On the 12th of February 2020, I published an article titled “Alan Jones is back grooming young male students for his sexual pleasure” which was based on an article published in the SMH. Can you explain why Alan Jones has never complained about my article or the SMH article?

The “Alan Jones’s 22-year-old boyfriend Jake Thrupp sends a legal threat to journalist” article

  1. On the 19th of February 2020 a lawyer named Anthony Jefferies from the law firm Gillis Delaney Lawyers acting for Jake Thrupp and his parents, Chantrel and Janson Thrupp, sent me a legal threat, which I didn’t receive for a few weeks, and I published an article on 18 March titled “Alan Jones’s 22-year-old boyfriend Jake Thrupp sends a legal threat to journalist”. Can you advise if Alan Jones paid for the legal threat given it is the same law firm being used by Alan Jones to sue the SBS and Alex Lee?
  2. Did Alan Jones ever have any sexual relationships with schoolboys when he was a teacher?
  3. Did Alan Jones ever have any sexual relationships with players when he was a Rugby Union coach or administrator?
  4. Did Alan Jones ever have any sexual relationships with players when he was a Rugby League coach or administrator?
  5. Has Alan Jones ever visited “The Wall” in Darlinghurst and pick up male prostitutes?
  6. Has Alan Jones ever visited male brothels in Sydney or anywhere else?
  7. I have written numerous other articles about Alan Jones such as “Paedophile Alan Jones took bribes off Qantas now he accuses Qantas CEO Alan Joyce of taking bribes off the Wagner family” on the 19th of May 2018 and “Alan Jones, the Jimmy Savile / Rolf Harris of Australian media” on the 19th of March 2016. Why has Alan Jones never complained about those articles and others I have written about him?
  8. Can Alan Jones confirm he is good friends with George Pell and recently had lunch with him? Is Alan Jones aware that George Pell has had adverse findings made against him by the Royal Commission into Institutional Responses to Child Sexual Abuse?
  9. How many court cases has Alan Jones lost for defamation and how much in total has he and/or his employer had to pay in compensation?
  10. How many times has the media regulators made findings against Alan Jones?
  11. How many times has the Australian Human Rights Commissions made findings against Alan Jones?
  12. Does Alan Jones agree that his reputation is so putrid by what comes out of his mouth that he can’t possibly be defamed by anyone else?

Can you please respond by 5pm today in case I have further questions and so I can publish.

Alan Jones’s legal team have so far refused to respond to the above questions even though they are all questions that he will almost certainly have to answer if the defamation case goes to hearing as they are relevant to his claim. If they do respond I will update this article or possibility publish another article.

Jones has used 2 barristers Sue Chrysanthou SC and Kieran Smark SC to file his claim in the Federal Court of Australia as reported by News:

They said the report wrongly claimed Jones “sought to incite racial violence” in the week leading up to the Cronulla riots, “was a racist” for criticising Muslims and Aboriginal people, “was a misogynist” for seeking out female politicians for criticism, and “was a liar” in that he lied to the public about climate change. 

They said SBS made “over-sensationalised” allegations made against Jones “greatly injured” his reputation and SBS had made no attempt to give him the right of reply before the clip aired.

“The applicant has been greatly injured in his business, personal and professional reputation and has been and will be brought into public disrepute, odium, ridicule and contempt,” the barristers wrote in the document.

“In circumstances where the nature of the material, being the making of seriously defamatory statements alleging criminality … were such that the allegations should have been put to the applicant so that he could respond to and deny the allegations.” (Click here to read more)

How can Jones barristers claim that “the allegations should have been put to the applicant so that he could respond to and deny the allegations” when I have clearly put 30 questions to them for this article and they have refused to respond and above you can also see an email I sent Jones’s employer on the 24th June 2016 and they also refused to respond. 

Jones seems to have picked the weakest target he could find and is going after them using two Senior Counsels, Sue Chrysanthou SC and Kieran Smark SC, to file his claim in an attempt to intimidate SBS to back down to avoid a costly legal fight.

Jones filing his claim in the Federal Court is possibly because they do not use juries, unlike the Supreme Court, and based on the average social media opinions of Jones that I have seen he would have no chance in front of a jury.

I have no doubt the claim will backfire on Alan Jones and his legal team. SBS haven’t filed a defence or response yet and hopefully they will fight it because they will win and because it is in the public interest to do so.  

Declaration: One of Jones’s barristers, Kieran Smark SC, is mentioned in my new book “Australia’s Paedophile Protection Racket” numerous times where I accuse him of criminal conduct and he even gets his picture in the book which he already knows about. I am also up against Mr Smark in the Seven v Dowling matter.

  1. Alan Jones probably figures there is no point suing parties like Kangaroo Court of Australia. Even if he wins in Court, and is awarded costs and damages, there would be virtually zero chance of Jones ever receiving a single dollar. Alan Jones would want to make sure anyone he sues has deep pockets.

    • Your comment doesn’t stand up to scrutiny as you have deliberately ignored key facts in the above article and you sound like an apologist for Jones.

      If Jones was to win any win he has against the SBS will be a Clayton win and will be seen as a joke. Jones had an opportunity to sue Chris Masters and the publisher of Jonestown in 2006 which he threatened to do but failed to back up. ABC Publishing buckled and wouldn’t publish it so Chris Masters went to another publisher. Jones could have sued them and the publisher would have had deep pockets. So why didn’t Jones sue them? Because he would have known that they could back up what was published and they are the ones who originally published the allegation that Jones sent a love letter to a schoolboy which Jones says in his defamation claim points to him being a paedophile.

      He has been prepared to be considered a paedophile for 14 years based on the book Jonestown and took no action. So why now? Even if Jones was to win against the SBS it would not override the allegations in the Jonestown book.

      You say he wouldn’t sue me because I do not have money. It hasn’t stopped Kerry Stokes suing and in fact, Alan Jones’s lawyers sent me a threatening legal letter a few months ago on behalf of his 22-year-old boyfriend which is again in the article above, He could have sent me a threatening letter in relation to the lover letters article I published about him in May 2015 but refused to do so.

      You also haven’t explained why he has refused to answer my questions.

    • What you say is quite plausible. And I cannot explain why Jones has not sued you or Chris Masters given that he has now sued SBS. And neither can I explain why Jones has not answered your questions. But then you have not explained these anomalies either. You seem to be as puzzled as I am. But the fact that neither you nor I know these things does not mean there is no answer, or that the answer will not be revealed to us at a future time. 🙂

        Well, actually I did: “So why didn’t Jones sue them?   2. Agreed, Colin. But the general point still stands. Some people argue that failure to complain about, or sue in response to, unfavourable commentary is a virtual admission of guilt. Of course, this is always a possibility, but it is not necessarily the only possibility. An alternative explanation could be that the target of the unfavourable commentary feels a response is not worth the effort involved. Analysis of financial cost and benefits might suggest it best to just let sleeping dogs lie and absorb any perceived personal injury. Or perhaps it might be reasoned that to respond formally would be to elevate the unfavourable commentary to a public level that is neither warranted nor deserved.

  3. Reference was made in the above story to Jones visiting “The Wall” to pick up male prostitutes. I recall someone saying on one KCA blog thread regarding a story about Jones that he was well-known for being driven down to The Wall by his chauffeur to pick up boys there. It may be a worthwhile exercise for KCA to try and contact that person and interview them about what he knew or saw about Jones’ nocturnal visits to this place. Such a person may know of other witnesses to such visits by Jones. A story based on the accounts of several such witnesses would be quite credible and of great interest to many.
    It’s one thing to cite letters Jones wrote to schoolboys: that only suggests grooming activity. But several accounts of Jones’ Wall visits (or even any first-hand accounts of encounters with him) would be certainly cause a stir, especially if he had been picking up under-age boys. While such an endeavour would require some journalistic leg-work it could be worth the effort. Some anti-Jones elements in the MSM news outlets might even pick it up, e.g. the ABC or The Guardian etc.
