Bill Shorten supporters Diana Asmar & Kimberley Kitching caught committing perjury at the FWC

Two of Bill Shorten’s closest supporters in the Labor Party have been caught perjuring themselves at the Fair Work Commission less than 2 weeks before Bill Shorten is due to give evidence at the Trade Union Royal Commission.

It reflects extremely poorly on Bill Shorten and it doesn’t matter what spin Shorten’s PR people put on it everyone will be wondering if Bill Shorten will also be perjuring himself at the Royal Commission.

I was in Melbourne on Friday interviewing Sue Hay in relation to the current corruption at the Health Services Union (HSU) when the judgment was delivered at the Fair Work Commission so the timing was perfect.

The two supporters are branch secretary Diana Asmar and Kimberley Kitching who have both been involved in the massive fraud and theft of member’s funds at the Health Services Union. Evidence Asmar and Kitching recently gave at the Fair Work Commission was found to be “unreliable and untruthful” which is almost identical to the findings of the Royal Commission last year. Someone who gives “untruthful” evidence in the witness stand under oath is committing perjury.

Vice President Watson of the Fair Work Commission handed down his judgment on Friday (26/6/15) regarding a long running matter with the HSU Victoria Number 1 Branch. VP Watson said at paragraph 227:

“Ms Kitching’s and Ms Asmar’s evidence has been found to be unreliable and untruthful in other respects.” (Click here to read the full judgment)

Background

The HSU Victoria Number 1 Branch has been run by Bill Shorten supporters since 2012. The main people running the branch have been Diana Asmar, David Asmar, Andrew Landeryou and his wife Kimberley Kitching. It is well-known they have been stealing everything they can from the union and that it is heading towards bankruptcy. At one stage they also ran a scam where the then general manager Kimberley Kitching did government accredited Right of Entry permit tests for other union employees at the branch.

The Right of Entry permits (ROE) are issued by the Fair Work Commission and are needed by union officials to enter workplaces.

The Fair Work Commission made adverse findings in March 2014 against numerous employees of the HSU Victoria Number 1 Branch (also known as the Health Workers Union) for running the ROE scam. This included Diana Asmar and Kimberley Kitching.

Diana Asmar and Co started playing all the legal games to avoid and delay the FWC findings.

The Royal Commission investigated the HSU Victoria Number 1 Branch last year for the ROE scam and Commissioner Dyson Heydon made these recommendations for criminal charges:

128: For the foregoing reasons, it is recommended that a copy of this Interim Report be referred to the Commonwealth Director of Public Prosecutions in order that consideration may be given to whether:

(a) each of Diana Asmar, David Eden, Darryn Rowe, Nick Katsis, Saso Trajcevski-Uzunov and Lee Atkinson should be charged with and prosecuted for making a false statement in an application or recklessly making a false statement contrary to ss 136 and 137 of the Criminal Code (Cth); and

(b) Kimberly Kitching should be charged with and prosecuted for aiding and abetting the contraventions of each of Diana Asmar, David Eden, Darryn Rowe, Nick Katsis, Saso Trajcevski-Uzunov and Lee Atkinson. (Click here to read the full report

The below interview is with Sue Hay who is a delegate for HSU members at the Monash Medical Centre. Ms Hay is not an employee of the HSU but liaises with the HSU on behalf of members who work at the Monash Medical Centre. Ms Hay has a good knowledge of the people involved and what is happening inside the HSU Victoria Number 1 Branch which is still under investigation by the Royal Commission.

The following HSU employees are still on the books being paid huge money and cannot perform their roles for the members in the workplace because of their ROE permits being revoked by Vice President Watson.

1. Diana Asmar – State Secretary $140k + car 2. David Eden – Assistant Secretary $130 + car 3. Nick Katsis – Senior Industrial Officer/Lead Organiser and elected official of the Branch committee of Management 4. Lee Atkinson – Snr Vice President and Organiser $110K + car 5. Dean Sherriff – Industrial Officer who cannot go to workplaces to address members issues $100K + car 6. Darryn Rowe – Country Organiser $80K + car. They should all be sacked but aren’t because they are Bill Shorten’s mates.

I decided to go to Melbourne to interview Sue Hay as the current corruption happening at the HSU is being orchestrated by Bill Shorten and his supporters. The people named above and in the interview are all likely to be in the witness stand at the Trade Union Royal Commission in the next few months as the RC have stated they are still investigating Diana Asmar and her leadership of the HSU Victoria Number 1 Branch.

Shorten tries to claim that other allegations made against him by the mainstream media is old news but what does he say about the current corruption by him and his supporters at the HSU Victoria Number 1 Branch?
