Bill Shorten supporters Diana Asmar & Kimberley Kitching caught committing perjury at the FWC

Two of Bill Shorten’s closest supporters in the Labor Party have been caught perjuring themselves at the Fair Work Commission less than 2 weeks before Bill Shorten is due to give evidence at the Trade Union Royal Commission.

It reflects extremely poorly on Bill Shorten and it doesn’t matter what spin Shorten’s PR people put on it everyone will be wondering if Bill Shorten will also be perjuring himself at the Royal Commission.

I was in Melbourne on Friday interviewing Sue Hay in relation to the current corruption at the Health Services Union (HSU) when the judgment was delivered at the Fair Work Commission so the timing was perfect.

The two supporters are branch secretary Diana Asmar and Kimberley Kitching who have both been involved in the massive fraud and theft of member’s funds at the Health Services Union. Evidence Asmar and Kitching recently gave at the Fair Work Commission was found to be “unreliable and untruthful” which is almost identical to the findings of the Royal Commission last year. Someone who gives “untruthful” evidence in the witness stand under oath is committing perjury.

Vice President Watson of the Fair Work Commission handed down his judgment on Friday (26/6/15) regarding a long running matter with the HSU Victoria Number 1 Branch. VP Watson said at paragraph 227:

“Ms Kitching’s and Ms Asmar’s evidence has been found to be unreliable and untruthful in other respects.” (Click here to read the full judgment)

Background

The HSU Victoria Number 1 Branch has been run by Bill Shorten supporters since 2012. The main people running the branch have been Diana Asmar, David Asmar, Andrew Landeryou and his wife Kimberley Kitching. It is well-known they have been stealing everything they can from the union and that it is heading towards bankruptcy. At one stage they also ran a scam where the then general manager Kimberley Kitching did government accredited Right of Entry permit tests for other union employees at the branch.

The Right of Entry permits (ROE) are issued by the Fair Work Commission and are needed by union officials to enter workplaces.

The Fair Work Commission made adverse findings in March 2014 against numerous employees of the HSU Victoria Number 1 Branch (also known as the Health Workers Union) for running the ROE scam. This included Diana Asmar and Kimberley Kitching.

Diana Asmar and Co started playing all the legal games to avoid and delay the FWC findings.

The Royal Commission investigated the HSU Victoria Number 1 Branch last year for the ROE scam and Commissioner Dyson Heydon made these recommendations for criminal charges:

128: For the foregoing reasons, it is recommended that a copy of this Interim Report be referred to the Commonwealth Director of Public Prosecutions in order that consideration may be given to whether:

(a) each of Diana Asmar, David Eden, Darryn Rowe, Nick Katsis, Saso Trajcevski-Uzunov and Lee Atkinson should be charged with and prosecuted for making a false statement in an application or recklessly making a false statement contrary to ss 136 and 137 of the Criminal Code (Cth); and

(b) Kimberly Kitching should be charged with and prosecuted for aiding and abetting the contraventions of each of Diana Asmar, David Eden, Darryn Rowe, Nick Katsis, Saso Trajcevski-Uzunov and Lee Atkinson. (Click here to read the full report

The below interview is with Sue Hay who is a delegate for HSU members at the Monash Medical Centre. Ms Hay is not an employee of the HSU but liaises with the HSU on behalf of members who work at the Monash Medical Centre. Ms Hay has a good knowledge of the people involved and what is happening inside the HSU Victoria Number 1 Branch which is still under investigation by the Royal Commission.

The following HSU employees are still on the books being paid huge money and cannot perform their roles for the members in the workplace because of their ROE permits being revoked by Vice President Watson.

1. Diana Asmar – State Secretary $140k + car 2. David Eden – Assistant Secretary $130 + car 3. Nick Katsis – Senior Industrial Officer/Lead Organiser and elected official of the Branch committee of Management 4. Lee Atkinson – Snr Vice President and Organiser $110K + car 5. Dean Sherriff – Industrial Officer who cannot go to workplaces to address members issues $100K + car 6. Darryn Rowe – Country Organiser $80K + car. They should all be sacked but aren’t because they are Bill Shorten’s mates.

I decided to go to Melbourne to interview Sue Hay as the current corruption happening at the HSU is being orchestrated by Bill Shorten and his supporters. The people named above and in the interview are all likely to be in the witness stand at the Trade Union Royal Commission in the next few months as the RC have stated they are still investigating Diana Asmar and her leadership of the HSU Victoria Number 1 Branch.

Shorten tries to claim that other allegations made against him by the mainstream media is old news but what does he say about the current corruption by him and his supporters at the HSU Victoria Number 1 Branch?

  1. Ms Kitching was at one time a frequent – and favoured – guest on Andrew Bolt’s show. There were all sorts of stories doing the rounds as to why, none of which I will go in to here. To me, back then, she came across as too slick by half and as dodgy as hell. It would seem my gut feelings from those times might have been more accurate than I realised at the time.

      • When a person like Bolt is friends with Kimberley Kitching, Graham Richardson, Paul Howes etc, it exposes Bolt as a shill.

    • Bolt has numerous commentators from both sides of politics. Some he apparently likes, some he does not seem to like. Kitching is ambitious and would appear at the opening of an envelope to further her political ambitions. I think her time has passed. Her activities and that of her husband appear to indicate a dodginess that even the ALP would baulk at.

  2. Wonderful interview with Sue Hay, Shane. It confirms & shows the full extent of Bill Shorten’s criminal crew running the HSU Victorian branch, & the nasty, disgusting contempt they have for their members. Diana Asmar, Kimberley Kitching & others are surely finished now. I believe now that the Victorian police will charge these rotten people when the Royal Commission is finished with them. Asmar, Kitching & others are confirmed criminals now. Bring on the HSU Victorian branch investigations Part 2 in the Royal Commission extremely soon.

I read the entire judgment and surprised that Michael right of entry was not cancelled as to hold 9 minutes and a bit to travel from Malvern to the Branch office and this includes parking, getting into the office, logging on to the computer network is a bit rich. perhaps an actual test to try this would have been appropriate to have been done. As for Ms Lee in view of her cooperation and honesty I view despite of her conduct she should not be charged. Presenting evidence such as her IP address clearly was critical for FWC to ascertain the truth and so her co-operation and honesty should in that case have been held in her favour. How this would affect Bill Shorten however is a question, because there has to be a direct link to show Bill Shorten was somehow connected to Asmar and/or Kitching regarding this all. As to the jurisdictional issue, I concur that one cannot proceed with any hearing unless the jurisdictional matter is first disposed off, as I often used this myself as an objection. I found the FWC judgment ex in details/set out and findings other then what I previous stated.

  4. “Oh what a web we weave when we set out to deceive”. The protagonists in this sorry saga will need more skill than Houdini to wriggle out of this one. It will be interesting to see who breaks first, crosses over and offers the Commission a hand. It’s dog eat dog now. Couldn’t happen to a nicer bunch of b*******s.

  5. Wow.!! I am staggered as how much the HSU is paying these overpaid wasters as they cannot fulfil their duties because of their revoked permits. Over $500000 in salaries alone! What a joke this is for the members to see such wastage of their funds.

    • How does Ms Asmar get to and from work then? What evidence do you have that her parents utilise a HSU member paid vehicle? How do you know where the parents live iseered? Have you informed TURC of inappropriate use of HSU car?

  6. Knowing this why do the members continue to pay membership fees to the HSU No 1 branch? Why not just collect the fees and hold them in a Trust account with a Solicitor. They would have proof that the fees are paid and would be transferred into HSU account once this fraud has been sorted. Mr Brown could surely authorise this so that the fees can no longer be used to bolster the wages of these corrupt people.

  7. I agree with Suse why do we continue to pay our fees to fund outrageous salaries and legal fees? I would be happy to pay another union to represent me or set up a trust account to protect members money because there will be nothing left in the coffers after all the legal fees are paid.

    • You are very trusting! why would you still want to belong to a union, after all that has transpired!

  8. Suse has hit the nail on the head. Why would any sound thinking worker give money to an organization whose elitist members thieves it for their own use. These people are one of the lowest paid workers in this country. Billy Shorten signed away thousands of dollars making deals with large companies for the benefit of his cohorts it appears. It is about time the Union Movement was made to present an audit and undergo annual scrutiny like any other organization. The whole lot should be totally transparent, with out any secret dealings behind the workers backs. There shouldn’t be any corporate credit cards. Board Members who have to travel can get their secretaries to book their travel for them and be billed for payment. NO free cars. Use their own and be paid mileage like so many of their Union members have to do.
