Justice Lee, for the second time, has flagged finding that Bruce Lehrmann and Brittany Higgins did have sex. Justice Lee sent an email on the 20th of February 2024 to all the parties in Lehrmann’s defamation case asking, “a question relating to a hypothetical scenario in which Ten’s defences failed but “no damages, or nominal damages” were “determined to be the appropriate award”.

Put Justice Lee’s email together with Justice Lee’s questioning of key witness Fiona Brown last year, as per the below video, where he also made it clear he was going to find they did have sex, then it is hard to imagine Justice Lee doing a backflip from that position given he has raised it a number of times now.

If Justice Lee does find that Bruce Lehrmann and Brittany Higgins did have sex it does not mean he will also find that Lehrmann raped Brittany Higgins. But either way Lehrmann will have a huge problem because he gave evidence under oath that they didn’t have sex. 

On the 19th of December 2023 I published the below video titled “Justice Lee gives biggest clue yet on how he will decide the Bruce Lehrmann defamation case” where I discuss the interactions between Justice Lee and Fiona Brown, on the 18/12/23, regarding whether or not Bruce Lehrmann and Brittany Higgins did have sex:

Justice Lee made it obvious during the defamation hearing himself and his staff monitored social media and that would have included this website and the KCA social media accounts.

So, Justice Lee would have understood that the questions he emailed to parties on the 20th of February 2024 asking about Lehrmann winning but with “no damages, or nominal damages” that was “determined to be the appropriate award” would be reported. Justice Lee would have also known that his question was likely be used by the media to indicate a possible judgment as I had previously done in the above video in December 2023. 

The SMH reported on Friday (1/3/24):

“In written submissions filed this week and released by the court on Friday”

The submissions reveal Lee asked the parties supplementary questions in an email on February 20, including a question relating to a hypothetical scenario in which Ten’s defences failed but “no damages, or nominal damages”, were “determined to be the appropriate award”. (Click here to read more)

It is interesting to see what I have written above and the old media’s reporting on the same new documents the court released on Friday. The old media, singing from the song sheet supplied by Bruce Lehrmann’s lawyers in their written submissions, attack Brittany Higgins as per below:

The old media missed the real issue and that is if Justice Lee finds Bruce Lehrmann did have sex with Brittany Higgins, which he has flagged doing at least twice, that means Bruce Lehrmann committed perjury at the defamation trial.

It would also mean Lehrmann’s barrister Steve Whybrow lied to the court, on Lehrmann’s behalf, at the rape trial.

Even if Channel 10 and Lisa Wilkinson fail in their defences, if Justice Lee gives Bruce Lehrmann any compensation it will scandalise the court given the limitless perjury Lehrmann spewed out in the witness box, under oath.

One issue that has not received much attention in recent times, but Justice Lee should address in his judgment, is the fact that Justice Lee granted Bruce Lehrmann an extension of time to file his defamation claim because Lehrmann filed it outside the 12 month time limit.

Justice Lee granted the extension of time for Bruce Lehrmann to file his defamation claim even though he found Lehrmann was a liar. I published an article in April 2023 and said:

“Bruce Lehrmann had a big win in court on Friday (28/4/23) because, in an extremely strange judgment, Justice Michael Lee made a finding of fact Bruce Lehrmann is a liar yet Justice Lee still found in Lehrmann’s favour. Be that as it may, the judgment is almost certain to turn out to be a poison chalice as Justice Lee flagged forcing Lehrmann to file an affidavit with his version of events surrounding the alleged rape of Brittany Higgins.” (Click here to read the full article)

If Justice Lee was to find in Bruce Lehrmann’s favour in his final judgment, in any way, it would be the second time that Justice Lee has ignored Lehrmann’s many lies and found in Lehrmann’s favour. That wouldn’t be perceived bias, but actual bias, and actual bias by a judge equals judicial corruption.

Justice Michael Lee should ring corrupt former judge Walter Sofronoff and ask him what a dodgy judgment does for your reputation.

Justice Michael Lee has said he will hand down his judgment by the end of March or early April.
