The Bondi shooting blame game – Australian courts will decide, not politicians!

There is a huge blame game going on over who should have stopped the Bondi shootings, but with dozens, and possibly hundreds of lawsuits for negligence over the Bondi shootings certain to happen, it is the courts who will decide who is responsible and for what.

In this article I will deal with some of the arguments the courts will hear debated in any negligence court case. Evidence such as government and Jewish leaders knew something like the Bondi Massacre would happen and failed to properly prepare, the location of the event which gave the shooters every advantage to carry out the massacre and the lack of police and security.

But one argument the courts won’t hear is that Prime Minister Anthony Albanese is responsible for the Bondi shootings because he failed to take enough action on antisemitism. And the reason you won’t hear that in court is because if anyone ran that argument they would be laughed out of court.

There has been a huge pile-on blaming Australian Prime Minister Anthony Albanese, but he didn’t organise the event, pick the location for the event nor have a say in the security for the event.

I’m no fan of Albanese as regular readers know and if he wants to resign that would be great. But he should resign over something he did do, not something he didn’t do.

The first port of call for responsibility for any death or injuries at any event is always the management and/or organisers of the event, and that seems to have been forgotten at this point, although the courts won’t forget.

The people who will likely sue are families of the deceased, people injured physically and people with psychological or emotional trauma from the Bondi shooting.

Likely targets of any negligence lawsuits are the organisers of the Hanukkah Jewish festival, federal government, NSW state government and the Waverly Council.

The Waverly Council logo is on the flyer (middle right side – orange and blue logo with “Waverly” under it) promoting the event, as per below, which possibly means they have to take some ownership of liability. Given it was a Waverley Council park they should have public liability insurance and so should the festival organisers.

Government and Jewish leaders failed to prepare

In the video Alexander Ryvchin makes some statements and admissions that are worth noting. He says at the 2.20 mark, “these people saw soft targets. They saw fish in a barrel. And they ploughed them down with hunting rifles”.

From the 3.30 mark onwards, they talk about how they told the government and at the 4.12 mark he says “We knew what was going to happen, we didn’t expect the government to know. But we know through our experience. We showed the government, we told the government.”

Alexander Ryvchin will be a star witness at any negligence case as he said the Jewish community knew what would happen and that they told the government what would happen. ACA even give the video the title “Jewish leader warned of Bondi-like attack” which says it all.

Numerous politicians and others have also been telling the media in the last few days that the government knew and were warned that something like the Bondi shooting would happen. Some of them might also be called as witnesses in any court case.

Location – The perfect kill zone?

As Alexander Ryvchin said in the above video, it was like shooting fish in a barrel for the killers. There were an estimated 1000 people there and they were in an open park with nowhere to hide. The shooters parked there car next to the overpass and only had to walk a couple of meters to an elevated position and start firing.

The festival should never have been allowed to take place in the park. They say they knew something like the Bondi shooting would happen, yet they planned an event were a 1000 people had nowhere to hide to protect themselves.

The killers chose the overpass as it was an elevated position, but if they couldn’t use the overpass there are 10 to 15 unit blocks across the road they could have used.

In one article I read where someone said that if police were positioned at the overpass the shooting would not have happened. Given the shooters had so many options with all the units across the road I think they would have just chosen another shooting location at one of the unit blocks and still gone ahead with their massacre.

If the festival had of taken place in a protected location, such as the Bondi Pavilion which was only meters away and has brick walls surrounding it, then people might still have died but the casualty numbers would have likely been a lot lower. 

Any security expert would have looked at the location and warned against having the festival there as it was a kill zone waiting to happen with dozens of elevated positions for terrorists to attack. 

So, did a security expert look at the site beforehand and if not, why not?

Why is it so important for shooters to have an elevated position? So they can better see their targets and also better see any threats such as the police.

There were 1000 people at the event and only 2 or 3 police, but the terrorists managed to take out 2 police early which the elevated position would have helped them achieve. And that is why a festival at an open park with no protection for the public and dozens of protected and elevated sites for the terrorists around it was the perfect kill zone and should never have been allowed to take place. 

In any court case the defendant, likely the state or federal government, is going to have to explain why they allowed the festival to take place in an obvious kill zone.

Where were the security and/or police?

Below is a 30-second video of former federal treasurer Josh Frydenberg, who is Jewish, talking about Jewish armed guards as security for himself, his children at school, at sporting events and aged care. But where was the Jewish armed guard security on Sunday at the Bondi shooting? (Below video is an extract from an interview on the ABC’s 7.30 Report on the 17/12/25)

In the full version of the above video Josh Frydenberg asks why there was only 3 police patrolling at the festival for 1000 people and says that needs investigating which I agree, but he doesn’t mention why the Jewish security weren’t there and/or failed to respond to the shooting?

The Jewish community also have their own security business, Community Security Group, that supply armed guards for schools and aged care etc as pointed out by Josh Frydenberg. Where were they on Sunday?

Jewish leaders say they warned the government that something like the Bondi Massacre would happen, yet they seemed to have failed to warn the victims, chose a location that was the perfect kill zone for terrorists and failed to have armed guards at the event even though they say they have armed guards at all Jewish schools and aged care etc.

There is a powerful prima facie case, with the evidence above, for people to sue for negligence over the Bondi shooting and they can likely choose between suing the federal, state or local governments and/or the festival organisers.

The Bondi festival will be studied around the world as an example of how not to plan an event if you are expecting a possible attack.

The Bondi shooting is a tragedy and the first thing to do to make sure that something like it never happens again is to make sure safe locations are chosen for future festivals.

The main point I am trying to make in this article is to say that there are many issues that need to be discussed and decided, in and out of court, before we can draw final conclusions over many aspects of the Bondi shootings. So, we should back off a bit before blaming people.

  1. What Frydenberg had to say last night on ABC was outrageous & in very poor form. We know he has always seen himself as a one day PM of our country. Frydenberg is Israel First & biased when it comes to Israel & the Genocide there.

    • My Lord, the undeniable tragedy of Bondi is of course appalling, the giant elephant in the room that people are loath to mention is G..A..Z..A, tens of thousands of innocent including children slaughtered starved and decapitated on an Industrial scale in the aforementioned G..A..Z..A. FFS

  2. Further gun control is made much more difficult every time John Howard is wheeled out to put his point of view. So what are the Liberals planning, to oppose the future tightened gun legislation brought out by Labor? I know it’s not all about guns, but it’s a start surely ! I know a fellow in my suburban neighborhood who has eleven guns, all kept legally of course in a safe under constant video surveillance. Why does somebody need 11 weapons like this ? One flick of the main switchboard and his video surveillance will count for nothing ! Why was Josh Frydenberg allowed to take the easy route and blame Albo, when his community must accept a fair percentage of the blame of incompetence in its own decisions & security failures? Josh could’ve offered to work hand in glove with Labor to offer suggestions, opinions and offer his bipartisan support. Instead it’s all negativism and stoking the flames of hatred and blaming Labor from Josh.

  3. I believe that Frydenberg owes Albanese a public apology. Maybe if Frydenberg had any brains, he would realise that Netanyahu is the biggest negative factor in this scenario. What he has done to the Gazans is outrageous. And it appears, all to get the West Bank land. No wonder Muslims globally are on the offensive. If you keep on persecuting a race of people, there are repercussions. Albanese canNOT be blamed for Netanyahu’s genocide.
    I feel incredibly sorry for the innocent Jews. Better preparation should have been provided.

  4. T. E. Lawrence (of Arabia) saw the birth of the deadly and permanent Middle East tragedy by the betrayal of the Arabs at the Paris Peace Conference in 1919. The courageous film ‘Lawrence: After Arabia’ summed it up pretty well, but that’s not going to prevent the lawyers and other parasites from milking the Bondi shooting for all it’s worth. Indeed, why not an expensive Royal Commission to tell us what we already know? A legal-judicial junket is the go-to solution recipe for every deficiency of mankind these days when the truth is systematically ignored.

  5. Steps both State and Federal governments should have taken to prevent this event taking place: 1. Stop giving mealy-mouthed excuses for Israel’s genocide 2. Stop pretending that there is a crisis in anti-semitism happening in Australia 3. Stop conflating legitimate criticism of Israel with anti-semitism. 4. Stop conflating legitimate criticism of Zionism with anti-semitism. 5. Stop giving support to Australian arms traders supplying Israel (and talking about ‘non-lethal’ parts) 6. Stop the ridiculous, expensive and time-wasting lawsuits against people who are only guilty of trying to properly explain what is actually going on in the Middle East. 7. Stop facilitating the Israeli hasbara and the ‘official’ narrative. If they had taken these steps, I think there would exist a much stronger social cohesion without the imperative for lone gunmen to try and put things right.

  6. Prior to the genocide, the Jewish community blended in with society without fear. They didn’t require millions of taxpayer dollars in security. They can blame only one person: Netanyahu. Oh and those who supported him. In that respect, Albanese can take some of the blame, but he’s far from the most culpable. But only Netanyahu has created a genocide, killing 70,000 (minimum) unarmed, penned-in, helpless men, women and children. Frydenberg is a gross opportunist and shouldn’t be given airtime – but of course he will.

We need to focus now on the Albo/Minns committment to implement in full the demands (not recommendations) of Envoy Segal as this will surely mean that Each Way Albo will have to implement the demands (not recommendations) of the Envoy against Islamophobia. There are already plenty of laws against any kind of violence but the Govt & Opposition are hell bent on introducing more.

  8. I very much doubt there is any mass anti-semitism in Australia, apart from the usual suspect RW and Nazi extremist groups ASIO and the AFP have warned about for years. But there is a massive amount of anti-Netanyahuism, just as there is in Israel. This criminal Netanyahu regime that is responsible for the mass slaughter and destruction in Gaza, is no doubt the reason for this horrific retribution of this father and son militant attack in Bondi.
    KCA report is exactly right, it should never have been outdoors in the open. We understand the Rabbi that was shot is a known pro Netanyahu IDF agitator, no doubt the main target of the shooters.
    What Jewish groups in Australia, Israel and world wide need to do, is distance themselves from the Netanyahu criminal regime and demand the immediate arrest and prosecution of this criminal Netanyahu and work towards the two State solution. Netanyahu is a wanted criminal in every country in the world apart from the deplorable MAGA Trumpistan USA.
    And understand this, Friedenburg and the LNP/Hanson actually still support the criminal Netanyahu regime knowing they are wanted criminals worldwide. The LNP/Hanson and a very corrupted Media are inciting divisive hatred and projecting distractions from the real problem, which is themselves and their absolutely deplorable opportunist RW hate politics.
    Nuremberg is on at the movies, probably do everyone some good to go see it and remember just what these opportunist RW politicians and their corrupted media are capable of?

        No, the Nazis were a far-right, extremist political movement, not left-wing, despite using socialist-sounding rhetoric like “National Socialist” to attract workers, but their core ideology was ultranationalist, racist (especially antisemitic), anti-communist, and anti-democratic, fundamentally opposing traditional socialism, liberalism, and communism.

  10. You raise a very interesting point. Jewish organisations have long warned the Albanese Labor Government of the dangers of anti-Semitism leading to tragedies such as the recent Bondi massacre. The Albanese Labor Government sat on its hands and failed to do all it could have done in an attempt to avoid such tragedies. For that failure, Albanese needs to take responsibility. Yet, and at the same time, the Jewish organisations that warned of the dangers of unchecked anti-Semitism, also knew full well that the Albanese Labor Government had not acted in response to their earlier warnings. Despite this, however, the Jewish organisations were more than happy to allow their public festivals to proceed in locations, and supported by infrastructure, that was manifestly inadequate from a public safety point of view. If the Albanese Labor Government bears some responsibility for the Bondi massacre then so too do the Jewish organisations that failed to heed their own warnings.

  11. Freydenberg’s performance on 730 was utterly dishonest and will hopefully prevent his return to federal politics. The shootings happened because of Israel’s shocking behaviour and nothing else.

    • Frydenberg is a horrible opportunist and shouldn’t be given airtime, but of course he will. His alliegance is to Israel, not Australia.

  12. Millions of taxpayer dollars have been spent on security for the Jewish community but how much is enough? It defies logic that anybody could have stopped this horrible massacre. Perhaps the Jewish community should have taken a bit better care of themselves if they did, indeed fear for their lives?

  14. This tragedy isn’t about a single villain – it’s a chain of avoidable failures that demand scrutiny, not political theatre. Public safety isn’t decided on talk shows or social media; it’s about planning, risk assessment, and accountability – which the courts will ultimately sort out.

    Blaming the Prime Minister for an event he neither organised nor secured is a distraction. The real questions are harder: why did an exposed, open-air venue go ahead despite warnings of serious risk? Why were protective measures so minimal?

    Knowing danger is coming and doing almost nothing is not foresight – it’s failure.

    Equally corrosive is the conflation of criticism of Israeli government and IDF actions with antisemitism. That shuts down honest debate, divides communities, and distracts from the real issue: keeping people safe.

    Most Australians oppose violence everywhere – in Bondi, in Gaza – without targeting communities at home. Pretending otherwise is a tactic, not a truth.

    And the most disturbing part? The rush by politicians and commentators seeking advantage while facts are still emerging and families are grieving. That’s not leadership. That’s opportunism.

    If any good can come from this horror, it’s a focus on safer events, robust risk management, and restraint in public discourse – not scapegoating, fearmongering, or weaponising tragedy for political gain.

The New South Wales Zionist premier, Chris Minns, wants parliament to grant his government “extraordinary powers” to effectively ban pro-Palestine rallies for three months, claiming that “in [his] view the implications’ of holding such rallies could be seen in the Bondi terror attack that killed 15 people.”
    If our government decides to unleash draconian powers that totally negate our democratic rights, it should be, at the least, based upon hard evidence, rather than a Zionist’s biased and donation-fuelled opinion.

    • Agree. Minns has shown his anti-Palestine views many times, and the two bloodthirsty and misguided idiots who did this massacre played directly into the hands of Minns and the Israel lobby. Now we have Minns giving a classic demonstation of victim-blaming. What a tragic debacle.

  17. The attack at Bondi bears an uncanny resemblance to the October 7, 2023 Hamas attack on Israel. In both cases security was minimised. On October 7 it is alleged that Israeli forces were stood down, allowing Hamas to breach the Gaza-Israel border and kill or capture many Jews. In Bondi, we are told Jewish security was non-existent, and as a result, fifteen Jews were killed. Although the blame game is well under way, to me, the whole saga reeks of orchestration for propaganda and warfare justification on the part of the Israeli state, and for the continued removal of Australians’ legal firearms and further civil control on the part of the federal government. The unfortunate victims were just collateral damage in the greater political scheme of things, and the losers will be Australian citizens.

    The thing is, none of it adds up. The shooters had Isis flags not Palestinian. The assumption that pro Palestinian protests have any connection to this violence – made by politicians looks like an agenda being rushed through for pro Israel interests before investigation proves something different.

    • Absolutely. The key point is that the shooters did have ISIS flags, clearly showing allegiance to a global jihadist terrorist ideology, not Palestinian nationalism or Hamas. Meanwhile, pro-Palestinian protests are largely political and humanitarian, with no direct link to ISIS-style attacks.

      It’s concerning when some politicians, diplomats, media reporters, and public personalities rush to conflate pro-Palestinian activism with terrorism, which some interpret as promoting a pro-Israel narrative, even before all the facts are fully known.

      • I really wish this comment could get national exposure. It carries an important message for any thinking person – even for those who sincerely say “I stand for Israel”. The distinction between terrorism and Palestinian activism is a CRITICAL one that should be considered by all thinking Australians.

  19. The Bondi incident is tragic . The Gaza Genocide ( ongoing) and most of the so called enlightened world indifference to it is the mother of tragedy. To have Netanyahu of all people to threaten Australians about the violence is the mother of all joke.
