NACC refuses to answer media questions regarding MPs under criminal investigation

There are federal MPs and/or Senators who are currently, or have previously been, under investigation by the National Ant-Corruption Commission for criminal and corrupt conduct but we aren’t allowed to know who they are before we vote.

Below is an email I sent to the NACC on the 8th of April, and they have refused to respond:

Dear Sir/Madam

I am an independent journalist, and I have a few questions:

Background

On the 27th of March 2025, the Legal and Constitutional Affairs Legislation Committee held a hearing at parliament with the NACC who were led by NACC CEO Philip Reed. At the hearing Mr Read said the NACC have “8 current investigations that involve one or more former or current politicians”.

Questions:

  1. Can you advise what is the total number of former and current politicians being investigated in the “8 current investigations”.
  2. Can you advise how many of the total are current politicians and how many are former politicians in the “8 current investigations”.
  3. Is the NACC aware of the Implied Freedom of Political Communication in the Australian Constitution, as per Lange v ABC 1997 High Court of Australia, and what bearing it might have on the NACC?
  4. Does the NACC have legal advice on whether the NACC’s secret hearings, and any other secrecy provisions within the NACC, impinge on the Implied Freedom of Political Communication in the Australian Constitution? “(For example, we are 4 weeks away from a federal election and some of those people standing for re-election are potentially being investigated by the NACC and it is arguable that voters have a right to know who they are given it would go towards their suitability to be a politician and the NACC’s secrecy is therefore impinging on the Implied Freedom of Political Communication in the Australian Constitution.)

This article is a follow-up to an article I published on the 3rd of April titled “Which Labor and Liberal MPs are being investigated by the NACC? And NACC says its more than 8” which starts off:

Corruption at the National Anti-Corruption Commission should be front and centre during the federal election campaign but it isn’t because it leads straight back to the dirty deal between Prime Minister Anthony Albanese and opposition leader Peter Dutton to corrupt the NACC.

The Labor Party and the Liberal Party / National Party coalition have not mentioned the National Anti-Corruption Commission (NACC) once during the election campaign and it’s no surprise given how openly corrupt the NACC is and how much on the nose with voters it is. I think the corrupt NACC is a big issue for a lot of voters and if it is then that should help see more independents and minor party candidates being elected on Saturday (3/5/25). 

Whatever the result, the main indicator of where this country is heading politically is what percentage of the vote the Labor Party and Liberal Party receive.

If Labor’s and the Liberal’s vote keeps on decreasing like it has been for over 40 years then minority governments will be the new norm, at least federally.

The Guardian reported 29/4/25:

Australia is known for its duopolies – Coles and Woolworths, Qantas and Virgin, Labor and the Coalition. However, at least one of these may be coming to an end.

In the 1980s, Labor and the Coalition shared more than 90% of the primary vote between them and independent politicians were rare.

But at the 2022 federal election, the combined major party vote was at a record low of 68% and the size of the crossbench in the lower house reached a record high, with 16 MPs elected either as independents or from a minor party. (Click here to read more)

When a federal government, in collusion with the opposition, conceals from voters the names of politicians who have been, or are, being investigated for corruption then we have a government that is closer to a dictatorship than a democracy.

And that is why we need more independent and minor party politicians elected and that is how I will be voting, as I have for a long time.

  2. Too right the corrupt NACC should have been front and centre in the media during the election campaign. It was the first reason I decided neither major would ever get my vote again because it was the most obvious sign yet that both majors are absolutely corrupt. The second was their support of genocide, which is even more unforgivable. Both parties have done their dash in this household.

    • Agreed Jen. My family have basically voted Labour / Labor since the mid 1800s. After Morrison one could not vote LNP, so for me they go LAST. However with Albo truly showing up as ALBO-SLEAZY, to me this takes his mob to second last sitting in LNP lap. No politician seriously looking to help the populace would or could automatically accept AUKUS and its apparent backhanding nor would they put together a NACC where they could hide corruption rather than opening up to public scrutiny. Shows both major parties are equally corrupt.

  3. Thank You so much KCA, your persistance is relentless. Truth Always Rises and you play such a big part of that. I have not voted for either Labor or LNP since the days of John Howard. His refusal to apologise to our indigenous brothers and sisters was heartless and his support of the Bush administration. Both Labor and LNP are clearly same under the surface in their protection of wrongdoings of politicians, pandering to their corporate donors and the support of horrific violence and genocide. Neither party will ever get my vote again, it is one betrayal after another. You do a remarkable job KCA and I send you a sincere heartfelt “Thank You” for all your work!

    The featherbedded parliament is corrupt. That the essence of Australia should be focused on a rather dodgy building in Canberra with seldom a whisper from our desperate voices is a travesty of pretend democracy. Let our republic be all encompassing.

I heartily agree with this comment. Whether Dreyfus is to blame for the totally inept charade of our NACC I find hard to believe. It has to be collusion between Labor and the Coalition and as it stands is a total abuse of taxpayers money.
    The electorate really has been given no way to demand a thorough review of the current inappropriate NACC, unless we get a hung parliament. The whole outcome is an absolute sham!

    • Paul Brereton, the ex judge, retaining his job as Nacc Commissioner after failing to demonstrate an understanding of conflict of interest in matters relating to Kathryn Campbell tells us all we need need to know about about them integrity of the federal anti corruption body. They will spend our money protecting the integrity rot caused by politicians and senior public servants by going after low hanging fruit and creating the smoke and mirrors that keeps the rot safe.

  6. This is a backward spineless country being a colonised country with no sense of shame or recognition of its past and present. It will be 50years anniversary of the sacking of the Whitlam Government in November. The conservatives always win for they are better and lying maybe?

  7. Corruption at all levels must be exposed. Australians have every right to know who they are EMPLOYING to act on their behalf. We are their employers.
    Remove the title “Honourable” they are not worthy of it. Thanks Shane, keep the B’s honest.

The National Anti-Corruption Commission (NACC) has revealed its true colours: a toothless, secretive puppet show designed to protect the very people it was supposedly created to hold accountable. Eight investigations involving current or former politicians, and we’re not even allowed to know who? In the middle of an election?

    This isn’t oversight – it’s obstruction.

    And let’s not kid ourselves – both major parties are complicit in this disgrace. Labor and the Coalition have made a blood pact to keep voters in the dark, silencing any scrutiny that might dent their electoral fortunes. Albanese and Dutton have effectively turned the NACC into a political quarantine zone – where accountability goes to die in silence.

    This is not democracy. It’s cartel politics, and it stinks.

    And frankly, we the Australian people are sick to death of being treated like mugs. We are disgusted, ashamed, and outraged that once again – at the most critical time, an election – our right to know is crushed under the weight of political self-preservation.

    This isn’t just about corruption; it’s about contempt.
    And I will remember and act accordingly at the ballot box.

    • Well said, Fred. I feel exactly the same. Sadly, people will still vote for more of this…I’ve always said, we have a voter problem, first and foremost.

      • Its far more than a voter problem. This goes right across the fabric of the communties of the Australian people, media corporations and so much else is involved.

        Firstly, the REPRESENTATIVES of The People are yet to do their job honestly and with vigor, ethics, principle, values, compassion, knowledge – the List goes on and on.

  9. My vote was 100% a petty vote. I told my local Labor MP that they’d lost my support. The NACC and the Rocbodebt RC investigation debalcle was one reason. Secondly, refusal to lift people on Jobseeker – a majority of whom are over 50 and/or too unwell to work, often permanently – not even OUT OF poverty but even to POVERTY LEVEL. Why would they when it’s a political football that doesn’t cost them a cent in PR. They lifted the rate of every other social services payment except that. Screw people waiting for a diagnosis and/or going through potentially endless ‘treatments’ until they’re exhausted or dead. They can be petty, and so can we.

  10. Surely there’s a limit to the stench of the political climate. What will it take to awaken the somnambulists?
