How NACC Commissioner Paul Brereton hopped in bed with Robodebt Royal Commissioner Catherine Holmes to cover-up Robodebt crimes

NACC Commissioner Paul Brereton colluded with Robodebt Royal Commissioner Catherine Holmes to protect the 6 Robodebt criminals who should have faced charges by now.

The NACC released a statement on Thursday (6/6/24), as per below, saying they would not investigate, nor take any action, including against NACC Commissioner Paul Brereton’s good friend Kathryn Campbell, after sitting on the referral for 11 months.

Robodebt Royal Commissioner Catherine Holmes did 2 things that she should have never done, and Paul Brereton went even further with his corrupt conduct.

Holmes asked for an extension so the Royal Commission reporting date was extended from the 30th of June 2023 to the 7th of  July 2023, to allow the commission to make referrals to the newly established National Anti-Corruption Commission (NACC), which started operations on the 1st of July 2023.

The problem with that is one of the key Robodebt crooks is Kathryn Campbell who is good friends with NACC Commissioner Paul Brereton, as they were both officers in the Army Reserve, so there was immediately a conflict of interest.

Not only did NACC Commissioner Paul Brereton have a personal interest in the matter, which he admitted by claiming he stood aside from the matter, but Brereton was exposed only a few weeks ago in a government report of protecting senior ADF Officers from protentional war crimes and other crimes. If NACC Commissioner Paul Brereton protected his ADF mates from war crimes and other crimes, which the government report exposed, when he headed up the Brereton Inquiry into war crimes would he protect his ADF mate Kathryn Campbell? 

If Holmes hadn’t asked for an extension of time any referrals to the NACC would have gone to the Commonwealth Director of Public Prosecutions like they have for other Royal Commissions. 

Who came up with the idea to get the Robodebt Royal Commission an extension of time so it could refer matters to the NACC needs to be investigated. And why didn’t NACC Commissioner Paul Brereton refuse to take the referrals and tell the Royal Commission to forward it on to the Commonwealth Director of Public Prosecutions given his conflict on interest.

What NACC Commissioner Paul Brereton did was to sit on the referral for 11 months until the public heat on the issue had died down then he had an unnamed Deputy Commissioner issue a statement as per below saying the NACC is doing nothing. They could have said that 11 months ago.

Secret “sealed” section of the Robodebt Royal Commission Report

Robodebt Royal Commissioner Catherine Holmes says the sealed section was not publicly released because it recommends the referral of 6 individuals for civil action or criminal prosecution. Holmes says this section was sealed so as not to prejudice any civil or criminal proceedings that may arise.

That is an out and out lie by Robodebt Royal Commissioner Catherine Holmes who is a former Chief Justice of the Supreme Court of Queensland.

I have reported on other Royal Commissions such as the Trade Union Governance and Corruption Royal Commission and the Royal Commission into Institutional Responses to Child Sexual Abuse and they named people they referred to the Director of Public Prosecutions for criminal charges and they also published the evidence and recommended charges.

The NSW Independent Commission Against corruption also names people it has referred to the NSW Director of Public Prosecutions for criminal charges and what those charges are.

It stands out a mile because every lawyer in the country will tell you there was no legal basis for Commissioner Catherine Holmes not to name the 6 Robodebt criminals she recommended for charges in her report.

If Robodebt Royal Commissioner Catherine Holmes had not protected the 6 people she recommended for criminal charges, and named them like other Royal Commissions do, it would have forced the National Anti-Corruption Commission (NACC) to do something but instead the NACC has decided to allow the 6 Robodebt criminals to walk free.

And at least one of the 6 Robodebt criminals, Kathryn Campbell, just happens to be good friends with NACC Commissioner Paul Brereton.

We don’t know the names of the 6 Robodebt criminals but 3 pieces of evidence point to Kathryn Campbell being one of them. Firstly, Kathryn Campbell gave evidence at the Robodebt Royal Commission and perjured herself like no tomorrow.

Secondly, Kathryn Campbell was suspended from the public service by the government, without pay, and then resigned just days after the Robodebt Royal Commission gave it’s report to the government.

And thirdly, as per my previous reporting on Paul Brereton’s friendship with Kathryn Campbell and Governor-General David Hurley, Brereton concealed from the public what was the exact conflict of interest he had that forced him to step aside from the decision making on the 6 Robodebt criminals which is further corruption by Brereton, the NACC and a breach of open justice.

Paul Brereton is a former NSW Supreme Court judge and when judges have a conflict of interest and recuse themselves from hearing a case, they always publish a fully detailed judgment explaining what the conflict was and why it forced them to recuse themselves from the matter.

Paul Brereton didn’t even name which one of the three Deputy Commissioners that he delegated the decision to. So, the public once again can’t verify if the Deputy Commissioner has any conflict of interest or hold them to account.

Imagine if any of the courts in Australia decided not to put judge’s names on judgments because that is what Paul Brereton has done with the NACC’s decision to protect the Robodebt criminals.

The NACC says above, “In order to avoid any possible perception of a conflict of interest, the Commissioner delegated the decision in this matter to a Deputy Commissioner.” That is almost certainly related to some degree to my reporting on Paul Brereton’s friendship with Kathryn Campbell and her husband John Brennan who is also an officer in the ADF reserves. But because they don’t specify what the conflict is means there could be more conflicts than we know about.

Paul Brereton thinks he’s above accountability and he wants to work and live in the shadows as NACC Commissioner. The problem is the public want a lot of sunlight shone on the NACC’s work, or lack of work, so we know where the problems are.

Brereton hasn’t even been in the job 12 months and with the War Crimes cover-up for “the most senior officers” and Robodebt cover-up he has already been shown to be unfit to be NACC Commissioner.

  1. Very angry about this. The NACC decision is completely unacceptable and massive betrayal of the Australian people. Wrongdoers, no matter who they think they are must be held accountable exactly as the everyday person in the street would. Thank you, KCA.

  2. Does it not give you a warm fuzzy feeling knowing that you, the reader, lives in a society that so readily condones and supports corruption, you too; can give it a go! But only if you are very well connected or wealthy, if you’re not, just keep looking the other way…

    • It was predicted by KCA that prior to the introduction of the NAAC, due to its secret operations that the unit would be a dud, set up mainly to protect corrupt politicians and their corrupt mates, bipartisan support by Labor and LNP. History shows that when politicians set up Royal Commissions they historically select mates who have predetermined outcomes and never provide negative results against the vested interests who appointed them, meanwhile the only winners are the legal fraternity. It was blatantly obvious that Albonese and Dutton didn’t want to mirror reflect the NSW ICAC and run the risk of being exposed for their corrupt behaviours, hence both agreed to the formation of the NAAC with its secrecy provisions..if this fake federal agency does actually prosecute any corrupt officials it will be lower level public servants who will be the scapegoats, it was obvious that Commissioner Holmes lacked the guts to fulfill her role when she spruiked the “sealed” evidence result. The Trade Union Inquiry was a perfect example of appointments that lacked intergidy when the Commissioner showed his credentials linking himself to the Liberal Party.

  4. Had to laugh about ‘ensuring lessons learnt’. The NACC has gone from crime fighter to school headmaster in less than a year.

    The bottom line is – the Robodebt Royal Commission was a waste of taxpayers money into another waste of taxpayers money. The NACC is also a waste of taxpayers money. When they whinge about their trillion dollar debt remind them of who dragged this nation into recession.

There is no difference between Labor and LNP, yes they are different on the surface and Labor do a little more for Australians BUT at their core there is no difference often referred to as “two cheeks of the same backside”. I will NEVER, EVER vote for the UNI party of Labor or Liberal. Still no TRUST in politicians because of NO transparency!

  8. Things will only improve if we vote out the duopoly’s career politicians. Instead of calling for a republic (controlled by these same politicians) let’s push for a democracy.

    • Fully agree with these thoughts.
      I would consider myself to have republican leanings but have no trust in those who would be fighting to get their noses into the trough for leadership. Just look at the NACC.
      I prefer the present arrangement. We know where we stand.
      The Brits are cold, calculating and ruthless.
      This was perfectly shown by the notes and letters to the the GG John Kerr (or perhaps more John Cur?) from the then Prince of Wales pushing for and applauding the sacking of Gough Whitlam. I guess most would be aware of the current position that man now holds in the King-dom.

  9. In my honest opinion, this government-authorised corruption, perpetuated by the loyalty and friendship of the “old mateship creed” and supposedly independent anti-corruption bodies, is becoming alarmingly common in Australia.

    This emboldened phenomenon erodes public trust, exploiting the “she’ll be right mate” attitude of everyday Aussies.

    The citizens of Australia are increasingly weary of deceit and dishonesty from the two major political parties. Both have shown themselves unworthy of the trust placed in them, manipulating systems meant to safeguard democracy and fairness.

    As public disillusionment grows, it’s clear that significant changes are needed to restore integrity and accountability in governance.

    Simply put: “I’ve had a gutful of this ongoing corruption”

    Being a corrupt government that Labor is, I would expect that this website will be taken down if it receives too many complaints. It will just be like their proposed “combatting misinformation and disinformation bill” that will censor social media and prevent the “honourable” MPs from being accountable.

  11. Was Commissioner Paul Brereton appointed by Labor Attorney General Mark Dreyfus?
    How much responsibility does Dreyfus, maybe other Labor MPs have for the NACC failure to deal with the corruption that was Robodebt?
    And can we expect no politician or public servant in the future to be brought to justice by the NACC?

    • Sorry Irene (and others):
      I suspect only low level public servants who have stumbled will be fed through the mixer/mincer in an attempt to show that the NACC is working. We will never see politicians or top level public servants even being investigated. If their names come up, we may see something about it, but unlikely. If they are named, they will go in and be escorted promptly and politely out the back door and taken to a club to celebrate with their mates / peers.
      Cynical maybe, but after the GG/NACC Chair debacle and following Howard, the budgie smuggler, Morrison and now Albanese, that is really the only way one can look at it. Well at least only way ‘I’ can view the situation.
      (and I have had some exposure to politicians and departmental heads)

  12. Since we aren`t told the nature of complaints submitted to NACC, or even if they are acting on the matter, citizens who might have further information to back up the complaints won`t contribute. What a way to run a reform body.

  15. Please, would the recently elected so called teals form a party, get some more members like yourselves elected and campaign on really stamping out this corruption nonsense. As you people
    carry no baggage and would have nothing to fear, I believe you would get tremendous voter support. I am nearly 80 years old and am sick of what is happening to our great country.

  16. Meanwhile low-paid workers like bus or truck drivers are immediately charged for any inadvertent error they make that harms others – while these grubs go completely unpunished for the harms caused by their calculated and deliberate decision over a long period of time.

  17. The NACC reminds of the NSW ICAC under Irene Moss which often ignored widespread corruption in the government and public service. Moss was friend of the Premier, who was later employed by the Macquarie Bank run by her husband

  18. Now we have the AC scandal emerging with Hurley hovering in the background. These criminals may give themselves medals they do not deserve but eventually the Law must catch up with them.
