Corrupt NACC Commissioner Paul Brereton exposed protecting his mates in the ADF, including Governor-General David Hurley, from war crimes

National Anti-Corruption Commission (NACC) Commissioner Paul Brereton headed up the “Brereton Inquiry” into war crimes by Australian soldiers in Afghanistan with Brereton finding “that some responsibility for the “murder” of 39 Afghan prisoners and civilians could not fall on the most senior officers”.

The problem is that Commissioner Paul Brereton is also Major General in Australia’s Army Reserve so the “most senior officers” are Brereton’s mates and it should be no surprise that Brereton found they were not liable for the “murder” of 39 Afghan prisoners and civilians.

Brereton has been busted in his “Brereton Inquiry report” trying to protect his “senior officer” mates in the Australian Defence Force (ADF) which totally undermines Paul Brereton’s position as Commissioner of the National Anti-Corruption Commission (NACC).

The government also set up the Afghanistan Inquiry Implementation Oversight Panel to oversee the implementation of the recommendations in the Brereton Inquiry report.

A report by the Afghanistan Inquiry Implementation Oversight Panel was only released on Thursday (16/5/24) and the ABC reported:

Serving and former defence chiefs, including Governor General David Hurley, are facing fresh calls to take responsibility for command failures which may have led to alleged war crimes in Afghanistan under their watch.

A report from an independent panel appointed to oversee the landmark Brereton inquiry has finally been released, warning that a lack of accountability from Australia’s military top brass has generated “anger and bitter resentment” among troops and veterans.

In 2020, a report prepared for the Inspector General of the Australian Defence Force by Justice Paul Brereton recommended 19 soldiers be investigated by police for the “murder” of 39 Afghan prisoners and civilians, and the cruel treatment of two others.

Now, the subsequent Afghanistan Inquiry Implementation Oversight Panel has rejected Justice Brereton’s conclusion that senior commanders should not be held accountable for the murders of 39 Afghans.

“The Panel did not agree with the Brereton Inquiry’s view that some accountability and responsibility could not fall on the most senior officers and it suggested that issue should be the subject of further consideration,” it said.

“There is ongoing anger and bitter resentment amongst present and former members of the special forces, many of whom served with distinction in Afghanistan, that their senior officers have not publicly accepted some responsibility for policies or decisions that contributed to the misconduct, such as the overuse of special forces.”

Members of the oversight panel, led by former inspector-general of intelligence and security Vivienne Thom, also compared the failure of senior Defence leaders to accept accountability for war crimes to company bosses who face dismissal or even criminal charges for corporate collapses.

“In the private sector, major corporate failures result in both an organisational and individual responsibility,” the report handed to the government in November 2023 states.

“Personal knowledge or direct involvement of the senior officers in the causes or behaviour that led to the corporate failure are not required.” (Click here to read more) (Click here: for a full copy of the Afghanistan Inquiry Implementation Oversight Panel report)

For example, if an employee dies working for a company in breach of Workplace Health and Safety laws on a construction site, the directors can be found liable and jailed and fined, which Paul Brereton would know because he is also a former judge of the Supreme Court of NSW.

So, why did Paul Brereton fail to “look closely at the collective accountability and responsibility of Defence’s most senior leaders” as the Afghanistan Inquiry Implementation Oversight Panel found? Brereton was protecting his mates is the only conclusion that a “fair-minded lay observer might reasonably apprehend” and his job as NACC Commissioner is not tenable.

Paul Brereton position as NACC Commissioner is untenable

In a court of law, you do not have to prove real bias by a judge, you only have to show evidence that there is perceived bias and a judge has to recuse themselves from hearing the matter.

On the Judicial Commission of NSW website it says:

The test for determining whether a judge should disqualify himself or herself by reason of apprehended bias is the objective “double might” test: “whether a fair-minded lay observer might reasonably apprehend that the judge might not bring an impartial and unprejudiced mind to the resolution of the question the judge is required to decide (Click here to read more)

Kathryn Campbell, advisor to the AUKUS program on $900,000 per year, has been suspended for her role in the fraudulent Robodebt Scheme and is possibly facing criminal charges. Most people would not know whether her suspension is justified or not but in the video below she is in full flight lying, deceiving and showing contempt for a Senate hearing into Robodebt.

Paul Brereton – NSW Supreme Court judge

Paul Brereton was sworn in as a judge of the Supreme Court of NSW on the 15th of August 2005 which means he was appointed by the Bob Carr led Labor government. Although it must be noted that Bob Carr resigned as Premier on the 3rd of August 2005 and was replaced by Morris Iemma but the decision to appoint Paul Brereton would have been made months earlier while Bob Carr was still Premier.

The point is Paul Brereton is a Labor boy which explains his appointment as NACC Commissioner.

Not only is Paul Brereton a Labor boy but Labor was busted trying to appoint another Labor boy Stephen Rothman as a Deputy NACC Commissioner.

Protecting war crimes

Paul Brereton was appointed to head up the Brereton Inquiry and without a doubt they knew when he was appointed he would protect “the most senior officers” who were and still are his mates.

In December 2020, Mark Weinberg QC was appointed by the then Home Affairs Minister Peter Dutton as the Special Investigator to investigate alleged war crimes by Australian soldiers in Afghanistan. Weinberg has done virtually nothing since except collect his fat pay check.

In April 2021 I published an article titled “Mark Weinberg QC the corrupt former judge appointed by Scott Morrison to cover up Australia’s alleged war crimes” which starts off:

“Mark Weinberg QC believes some people such as judges are above the law and accountability and I know this for a fact because he was filmed on video in 2017 in court saying as much as per below. Both Paul Brereton and Mark Weinberg QC have been exposed publicly for their belief that certain people are above the law and they are both up to their necks in covering up war crimes.

But Paul Brereton is Commissioner of the NACC and can someone who believes certain people are above the law continue to hold his position as Commissioner?

I’ll keep on investigating because I don’t think Paul Brereton can survive as Commissioner and if he does, he will do a lot of damage to the federal government which is their own fault for appointing him in the first place.

  1. Is this the same Weinberg previously named in KCA in relation to Victoria Court of Appeal matter in relation to the late G.Pell as the lone dissenter and later shown by KCA to have received an award from the Church hierarchy. Coincidence or otherwise?

  2. Add in behavior of Cpl Ben Roberts-Smith, son of WA Reservist parents, retention of a VC despite gung-ho way in which it was awarded by his CO, Hurley. At least Roberts-Smith was not a member of Sydney University Regiment.

    Pathetic behaviour from those who have been placed in positions that warrant unscrupulous conduct.

    Over recent decades, Australia has transformed into a REGIME that increasingly MISTREATS certain individuals and community groups. This regime, along with its political, police, corporate, media, and judicial allies, processes, charges, and PROSECUTES PEOPLE UNJUSTLY. Meanwhile, those within this powerful “GANG” often ESCAPE ACCOUNTABILITY for civil, legislative, and criminal offences. This DISPARITY between the treatment of the powerful and the powerless deeply saddens me.

    Any holder, especially of Australia’s HIGHEST ORDERS, needs people of intelligence, initiative / energy, and integrity. Without INTEGRITY, the first two can be dangerous.

    Better to have someone lazy and dumb than SMART and UNETHICAL.

  5. Albo and co may have put a ‘toothless tiger’ in charge but the NACC could still have the powers it needs to fight corruption at the federal level. Is it just waiting for a real reformer at the helm?
