Australian Zionists, who do very little to hide the fact that they are doing Israel’s bidding, have taken a 3rd legal hit in 3 weeks. The latest being the discontinuance of a vexatious claim by Zionist Federation of Australia (ZFA) CEO Alon Cassuto against journalist Mary Kostakidis for breaching the Racial Discrimination Act.
NSW Supreme Court’s Justice Desmond Fagan handed down a damaging judgment exposing Zionist lies 3 weeks ago, which was legally supported when the NSW Attorney-General refused to appeal because an appeal had “no reasonable prospects and would fail.”
Alon Cassuto, who is the Zionist Federation of Australia (ZFA) CEO, had no choice but to withdraw his claim because his legal team would have told him he was going to lose badly after Justice Fagan’s judgment and the NSW Attorney-General’s endorsement of the legal standing of Justice Fagan’s judgment.
Justice Fagan’s judgment that helped Mary Kostakidis
Justice Fagan’s 2 key rulings were:
1. That the International Holocaust Remembrance Alliance (IHRA) is a definition of antisemitism that “appears to be an attempt to repurpose the term “antisemitism” as the name of an amalgamated concept of “hatred toward Jews” and/or criticism of Israel,” which I wrote about on the 23rd of August, 2026. 2. That criticism of Israel is not antisemitism.
But there is another ruling in Justice Fagan’s judgement that also meant Alon Cassuto’s claim against journalist Mary Kostakidis was futile, and not only would he lose his case in court, but he also ran the real risk of having indemnity costs awarded against him for continuing with a frivolous and vexatious claim.
Justice Fagan ruled that the defendant in the case State of New South Wales v Farhat (final) [2026] NSWSC 985 was not a supporter of Hezbollah even though he had a neck tattoo of a symbol associated with Hezbollah, incorporating an image of an assault rifle being held overhead. Nor was he antisemitic because of the tattoo.
Zionists have been claiming in the media and in recent court cases that almost everyone they don’t like is antisemitic and that has been their downfall. Australian courts at least have shown they won’t tolerate the Zionist lies.
NSW Attorney-General Michael Daley’s decision not to appeal
When asked about an appeal in an NSW Parliament hearing on the 31st of August 2026, Attorney-General Michael Daley said on page 15 of the transcript:
“No, we won’t be appealing that decision. I should say—I put it on the record now—following the Supreme Court’s refusal of an application for an extended supervision order against Mohammed Farhat, I sought urgent advice on the prospects of an appeal. Having considered the advice from Crown Solicitor senior and junior counsel, I reached a conclusion that an appeal would have no reasonable prospects and would fail.” (Click here to read the full transcript)
Alon Cassuto’s settlement with Mary Kostakidis
The ABC reported (12/9/26):
In 2024, Ms Kostakidis shared a video on her X account of Hassan Nasrallah, the now-slain leader of Islamist militant group Hezbollah, urging Jews to leave Israel.
In the video, Nasrallah says “Israelis don’t have a future” in the Middle East, and Ms Kostakidis captioned the post with: “The Israeli govt getting some of its own medicine”.
The ZFA alleged the post was anti-Semitic under the International Holocaust Remembrance Alliance’s definition, adopted by Australia, because it “denies the right of the Jewish people to self-determination”.
Ms Kostakidis’s lawyer argued the posts did not meet the “legal definition of anti-Semitism” and were “directed to the Israeli government” rather than Jews. (Click here to read more)
Based on Justice Desmond Fagan’s judgement on the 17th of August 2026, Mary Kostakidis would have won her case easily, as he found the International Holocaust Remembrance Alliance (IHRA) definition is a fraud.
And posting a video of former Hezbollah leader Hassan Nasrallah telling Jews to leave Israel when they are at war is hardly antisemitic, given having a Hezbollah tattoo by itself is not antisemitic.
It must be remembered it has been on the news dozens of times, if not hundreds of times, Israel telling Palestinians to leave certain towns before they bomb the towns. Does that make the Israelis antisemitic?
Mary Kostakidis announced on her social media “X” account on Friday (11/9/26):
Breaking: Zionists legal proceedings against me have been withdrawn after a 2 year battle.
This is a win for every Australian who values our democratic right to freedom of political expression. Zionist zealotry has had to beat a retreat from what was going to be a highly damaging trial.
I have spent 2 years doing nothing but preparing my defence in a case aimed at silencing me – a case that would have cost the average Australian their home.
I want to thank my fellow Australians who recognised the significance of what we stand to lose, stood with me and stepped up to assist me to launch my defence.

The Guardian reported on the (11/9/26):
In a statement published on Friday, Cassuto said his objectives in bringing the proceedings had been “substantially satisfied” after a public apology by Kostakidis in 2025 for the “hurt, distress and pain” felt by Jews and Israelis in Australia who took her posts “as an endorsement”. That is a clear lie by Alon Cassuto. If “his objectives” had been “substantially satisfied after a public apology by Kostakidis in 2025,” why did he wait until September 2026 to discontinue proceedings?
It is also my understanding that the apology by Mary Kostakidis happened on her “X” account in January 2025, was a limited apology for “hurt, distress or pain,” and she said that “the apology should not prevent the material from being reported or discussed.”
So, to believe Alon Cassuto, we have to believe his objectives had been substantially satisfied in January 2025, but he decided to wait until September 2026 to withdraw his claim.
The timeline makes it obvious why Alon Cassuto discontinued his claim:
- 17th of August 2026 – Justice Fagan publishes his judgment.
- 31st of August 2026 – NSW Attorney-General makes public he won’t appeal Justice Fagan’s judgment.
- 11th of September 2026 – Alon Cassuto, Zionist Federation of Australia (ZFA) CEO, discontinues the frivolous and vexatious claim against Mary Kostakidis. It should be noted that by the 11th of September Alon Cassuto’s legal team would have told him he is bound to lose his claim and should discontinue the claim.
For Alon Cassuto to claim he had a win shows he has no shame. I suspect Cassuto is nothing more than a puppet for his boss Zionist Federation of Australia President Jeremy Leibler and his father Mark Leibler.
Justice Fagan’s judgment has started a domino effect that has knocked out the claim against Mary Kostakidis, will likely have an impact on the Antisemitism Royal Commission findings and also have an impact on the hate crime charges against the 23 people in Queensland that are currently before the courts.

Dare I feel that there’s been a turn away from the conmerchants of Zionism? Finally? It’s an indictment of this and other countries, that they held us in their thrall for as long as they did. This time will go down in history as a shameful period in democratic government, when polilticians sought to alter reality – for some unfathonable reason I will never understand. There can be no closure from this period though, until those blighted politicians and bureacrats are held to account for what they did to their countries.

Why is it so difficult to accept that Zionism is a political ideology. It is not a race, nationality or ethnicity. It is no different from the others ‘isms’. communism, fascism, liberalism etc. Clearly, anti-Zionism cannot be classified as antisemitism.
Have you ever wondered why so many Govt’s support Israel’s theft of Palestine and turn a blind eye to the carnage they have inflicted endlessly for over 80 years? While the rest of us look on disgusted in horror? Protestors beaten by police. The only obvious reason has to be, that they don’t want these zionists anywhere near their own countries. Better to have all these genocidal religious zealots corralled into what was originally supposed to be a small enclave illegal settlement in Palestine, that now against over 70 UN resolutions over that 80 years, has now like a parasitic virus, it has consumed the entire country of Palestine.
